you should have talked with your landloard duing the time when the construction begins. I don't know for how long you have suffered with lose of sales, and what is the effects after the construction: will it bring more traffic to your store? if so, i think you should just make a friendly talk with your landlord, if possible to have some compensations or a ensure of further lease agreements. On other hand, if the construction will slow down your store traffic, make less sales in the future, this could be more complicated. All depends what you want to do in the future, if you want to keep the business in long run. you should build a good relationship with your landlord. Just simply don't pay rent is not a good idea.
