您的情況，最終只能經由對於車主的民事訴訟 (而且有可能您不能走小額賠償庭) 來求得任何修理所需要的賠償。同時如果對方是外州居民，將會明顯增加訴訟的難度。(樓上老檸檬已經說明) 當然，老貓不認為對方的保險公司會乖乖賠償所有修車的費用，最有可能是扯皮到 50-50 責任，所以各自修車。

您現在需要，

(A) 清楚取得車主的個資。(你需要將這個訴訟的資料送達對方手中，如果對方不是遊客，而是在紐約州或是紐約市居住或是工作，但是車牌還是掛佛州車牌)

(B) 三家報價修車所需。(將來訴訟時需要來證明您的要求不是空穴來風)

(C)提出 訴訟的法院可以是在事發的地區(如果你們雙方都是紐約市的居民，否則請參考下列有關 venue的資料)或是你所居住的 county. (如果你是紐約州的居民)。

A claimant must begin the lawsuit in the proper county. In general, a claimant can sue in the county where either party resides. If no party resides within the City, the action can be brought in the county where either party has employment or a business address. If the defendant (對方) does not have a residence, employment, or have a business address within the City of New York, you cannot bring the lawsuit in the Small Claims Court.
