small claim court

small claim court only award you money.  It cannot force HOA to do anything, nor can it order it to waive the fine. 

You need go to a general court.  And you need to read the HOA bylaws.  Your theory would be breach of contract, that the fine has no basis in the bylaws you signed.  

It could be tough to prove.
