修建Fence被邻居告，请问什么是Motion for preliminary injunction?

各位老师好，

我今年想自己房子修建一道fence，给两侧邻居打了招呼，也从hoa拿了批准。结果遇到了一个特别多市的邻居，找各种理由不想让我修建，最后他找到起初修建房子的secondary plat，里面有covenant，conditions and restrictions，有一条关于patio easement and patio fences的规定，说实话真心不适合我的情况，因为我向我的城市求证过我的房子是single family house，和这个patio fence没有任何关系。我的只是建立一个fence，而且也遵循了所有关于covenant中fence的规定。

 

我有两个问题想请教，

1，secondary plat是1992年的存档，但是hoa的网站上有一个2009年修订过的CC&P，这个情况下是不是应该按照新的CC&P来执行？

2，邻居把我和物业一起告了，现在让我停工，我是不是现在必须就停工了？还是现在的只是一个notice？原文是：

COMES NOW,Plaintiff,xxx,Pro se, having filed its Verified Complaint for Injunctive Relief and Attorneys' Fees, and moves the court to issue a preliminary Injunction prohibiting Defendants, xxx HOA and me from violating the covenants by allowing me to erect a fence in the Patio Area of his property...

WHEREFORE，Plaintiff requests that this Court set this matter and Motion for a hearing for the issuance of a Preliminary Injunction, estimated in good faith to take approximately one hour and for all other proper relief in the premise.
