I have been going back and forth with the Seller’s attorney in a heated exchange. Their office has admitted to receiving the letter on 9/10 which they never disclosed to us. Their attorney’s excuse is that he “presumed” I received the letter (which is ridiculous and I have done dozens of closings with this Attorney who KNOWS I would have never neglected something so significant had I had ANY knowledge of it prior to or at closing).
I just wanted to shoot you a quick message to let you know I am working on getting his client to incur this expense as they had an obligation to disclose this matter since it was not something we could have reasonably discovered (the Town didn’t even know of the issue until they went to read the water meter).
