does cashing a deposit means stepping into a binding contract?

我offer一个600K的房子， seller接受后在agent办公室起草合同。讨论合同细节花了两个半小时，基本条款价格deposit都谈好了。

合同全部起草好了而且买房双方都讨论同意了，但是说好等到下周三City inspection的结果后才签合同。我留下了40K check 作为deposit

结果今天agent说又有offer进来，有人offer 625K要我 match。

今天一看我的银行账户发现Deposit check 被title company cashed，这个动作是不是已经代表他stepped into a binding contract？

那天应该履行我那个600K的offer吗？
