根据你在TZLC的帖子，现在是你告房客不交房租，房客反告你违规处理押金。

麻省的规定是如果违规，你必须无条件地归还sec deposit；如果不归坏而导致房客动用诉讼，将受三倍惩罚（treble damage）。

我的观点：sec deposit违规和房客不付房租没有关系。所以在eviction court里面是两个案件，对方必须反诉而不是辩护。

再者，如果房客没有搬出，你还没有必要100%退回sec deposit，所以房客对于这个事物诉讼太早，法律上名义是“the issue is not ripe, therefore the court should dismiss the claim of improper handling of security deposit.”

在做这个辩护的同时，马上去按规定开户转账。
