Following is my more detailed background info. My tenant did not owe me any money at the time when she filed the Chapter 13. Also in her Chapter 13 plan, she states she will directly make the payment to me. I called her trustee to confirm just now and they want me to deal with her directly for all the rent payment.

Now she have not paid the May rent yet and my original plan was to go to bankruptcy court to file the montion to lift the "Automatic Stay" this week. Since the plan is confirmed already, am I OK to file the eviction in district court without the concern of the "Automatic Stay"?
