房屋买卖请教

本人在纽约州，在德州买房。看到一个房子，长话短说，递交了offer（比如，$35). 德州的交易，一出offer, 就需要买方直接递交单方面签了名的交易合同， 所以我们给了对方这个合同，由我们的签名，标价$35. 对方counter ($55)，在我们原来的合同上，把$35划掉，改成$55, 并在边上initial. 我们收到以后，决定split the difference， 取了中间值counter 回去 ($45),并说明了this is the most we want to pay，并把对方的数字划掉，写上了$45, 签了名字的缩写. 对方再次counter($50)（again, in writing, with the new number, and 签了initial) ，我们不同意，说我们不愿意付多于$45。他们回来告诉我们， congratulations, 卖方同意了我们的$45, we consider the contract executed， 然后寄给我们对方在我们寄给他们的$45的合同上的签名。我们没有再次签名，没有date the contract (但是对方put the date on the contract.) 现在我们因为种种原因不想要这个房子了.请问，我们算不算有executed contract? 谢谢。
