请大侠指点买 short sale 房的后续问题。

 

一直对一个gated 区感兴趣，后来一个 listing agent 找到我们，说有一个房 子是 private sale，原房主因面子问题不愿放在 multi listing，要价$980K。我 们去看了房子，比较满意，当时就签了 listing agent 准备好的合同，listing agent 说 buyer’s agent 是他的朋友，只是充个人头，以免银行扣 commission, 而他本人 handle 所有的事情。银行 counter 到 $107万，我们接受，11月20日 close escrow。早在拿到 short sale approval 后 listing agent 说原房主希望 能再住一个月以便于找出租房搬出去。我们同意，并于11月8日写了正式的email 给 listing agent 说应 cover 我们的 cost，每月$5300。11月24日新老房主及 listing agent 在房子见面，我们的原意是检查房子，签 lease agreement，并收 取房租。sellers提出要住到1月14日，因为在 holiday season 他们有许多旅行计 划，不能搬家。我们虽然希望早搬家以便孩子能及时在新学期开始的1月7日上学，但还是同意他们住，并当面对他们说房租是 $5300。listing agent 以现在检查房 子不礼貌和需要立刻带 sellers 去看出租房为由，让我们尽快离开。回家后的当 天我们写了正式的“our position on short term lease”， 以 pdf 的形式发给 listing agent，敦促他准备lease agreement让 seller 签字，并交纳房租和押 金。listing agent在两天后按照我们的意思准备了lease agreement，email 给 我们签字，再 email 给 seller 签字。最终十天后的12月4日listing agent 送 来了 seller 的信封，seller 把每月房租“$5300”划掉，改成 “$4000”，把 “$4000 security deposit” 划掉，改成 “upgrade in the house”，两处涂 改的地方都没有 initial 或 签名，形成事实上的无效 lease agreement，并 附有 $4000 casher check。我们于12月5日发了 3 day notice, 并退还了 $4000 casher check， 开始了 eviction。seller 第二天 回应说是 listing agent 对他们说 $4000/month 是 buyers同意的, 而他们在几年前买房后花费几十万 remodel，足以抵消我们要求的 security deposit。又说愿意付房租以求和平解决。但时至今日也没有收到新的 lease agreement 和我们要求的房租。我们准 备明天 file 到 court。

 

我的问题是: (1) seller 夫妇二人均有工作，我们是否能通过 eviction 和 small claim court 拿回损失？或者要求 court 拍卖他们的名车：porsche, Mercedes etc.; (2) 可否诉 seller 和两个 agent for breach the contract, 因为在 contract 里说 “seller should make property available 5pm of the date of escrow close”;(3) 可否诉 listing agent for not communicate properly between seller and buyer, and refuse to pick up the difference he made; (4) listing agent 两次说他把我们的 loan document 给 seller 看以 证明我们的 cost，这是否侵犯了我们的 financial privacy。请各位大侠多多指 点。
