来美前３年免税但在此其间交了140/485, 现被查，到底该不该免税？

2005 10月来美H１B，2007 7月放水时交了140 and 485, 2008 8 NIW140批了，现４８５pending，持H１B。

现IRS调查我２００８的税， 我当时申请了１０个月的免税（10.2005-10.2008), 其中一问题是Did you ever apply for and/or have been granted lawful greencard in U.S.,   if yes, please give effective dates  of such application and/or status.

问题：
１， 关于IRS的question, 我应该如实写我2007 7月交了140 and 485, 2008 8 NIW140批了，现４８５pending， 是吗？

２， 我该不该免税？是不是从我交的时间2007.7 (effective date should be 2007. 9)就开始不能免税了？那我要返回给IRS的也太多了，我都拿不出这个钱来。
