I hired a Chinese who said he is a CPA to file my tax return. he told me I do not need to pay any tax for 2002 becuase of various deductions. Like $5000 treaty exemption for F1 student, tutition, etc. What he did is to file a 1040X that report this income but shows I do not owe any money to IRS because of various deductions.
And then he did not sign as the tax form preparer for me, he just wanted to secretely take the money I paid to him without taking any responsibility or paying any tax for this income.
Now I think his calculations are wrong, but I could not prove it is somebody else who prepared the tax form. What a sneaky person he is! He should tell me he could not do it if he did not feel confident about my tax form, instead of doing it in the wroing way!
The address he gave me to file form 1040X is in Philadelphia. But the letter I got later is from IRS in Upstate New York. They are different centers!
Since the way 1040X was filed before was wrong, in the old form, I should accompany various supporting documents but I didn't, and it is very hard for me to get them now.
I do not want to argue with IRS about the amount, just want to pay all tax amount and interest and have this thing settled.
But do you guys think I should include the copy of 1040X I filed? (which is filled wrong and I do not have enough supporting documents for that), or should I just pay the amount and not mentioning the copy of 1040X I filed? I don't want to cause any trouble for later visa and immigration status.
