哈弗请了一个叫 David Card 的Cal 经济学教授，审查了6年的admissions data, 搞了个数学模型，然后写了个expert report，卡德教授结论：没有种族歧视。
原告SFFA 请了一个叫 Peter Arcidiacono 的Duke 经济学教授，审查了这6年的admissions data, 搞了个数学模型，然后写了个expert report，阿奇教授结论：哈弗大学的对申请人的 personal rating is biased. The disparity is striking. 那么这个personal rating 到底是不是biased?
阿奇教授的又一个模型说：除了race, 根本不能解释亚裔学生的低分。打分1-6分，亚裔如果和白孩子同样标准，得1-2分的机会会增加至少20%。
卡德教授对亚裔的personal rating 低分的解释是：不是种族原因，是未知原因。未知原因是什么？有可能是applicant’s personal essay， support letters “from figures like research supervisors or extracurricular instructors"，也有可能是differences in unobservable factors! 另外卡德教授对为啥校友打分和校方打分差别那么大的解释是：校友打分不是统一标准的打分。
