我老婆在我们拿到美国绿卡后, 由于某些工作原因, 两年前回国在某大学任教, 过渡一下, . 她本来可以经常在寒暑假或学术访问期间经常回美国探亲, 她绿卡的在美期限问题并无大碍. 但现在疫情当前, 她往返中美极不方便, 已经困在中国快大半年了, 我们入籍期限又快到了. 不知8老师或别人有何建议?

-She needs to come back to US before her continuous stay in China reaches one year if she has no reentery permit or returns to US before the reentry permit expires if she has the reentry permit. Otherwise, her green card will be void.

Of course, she may apply for SB-1 visa to return to US to reativate her green card if she overstayes in China. But she nees to have the convincing reasons to justisfy the SB-1 visa application. The VO is normally is very picky for SB-1 visa, so Covid influence itself probbaly may not be enough as the justification for SB-1 visa).
