Hi 8老师，事态紧急啊，我简单说一下我L1B转L1A的情况，跪求8老师帮忙分析一下该如何做。

我L1B签证5年期满，4个月前开始申请L1A签证。7月份收到REF补交材料，第二次补交后，刚刚查到，USCIS拒绝了我的L1A申请。
我L1B工作许可在8.31号已经到期，想问一下接下来该如何操作？
1. 我的身份是不是立刻不合法了？有多长时间必须离境？

-You have been out of status since your L-1B reached the 5 year limit.

我的I94时间显示是到2019年，这表明可以留在美国吗？

-It seems USCIS/CBP officer mistakenly issued the I-94 duration over the 5-year L-1B limit. Nomrally, if you have an unexpired I-94, then your presence in US is not counted as unlawful presence although you are out of status. But because your I-94 duration is not normal, I have no idea. You had better consult an experienced immigration lawyer.

2. 可不可以提起上诉？

-Yes, you can file I-290B. Talk to your lawyer.

上诉的条件是什么？成功的概率有多大？

-Depends on what the denial reason is.

上诉之后有多长时间可以留在美国？-You can stay in US legally during the I-290B pending, but if you fails, the unlawful presence (if any) will be counted form the date when your L-1A application was denied.

期间可以工作吗？-No.
3. 如果上诉失败，会不会影响下次来美国？如果一年以后再申请L1A，会不会受上诉失败的影响？
4. 如果必须离境，可不可以立即申请B1来美国？

-Techincally, yes. But whether you can get the B-1/B-2 visa depends on whether your application reason to convince the VO as everyone does.

会不会影响以后L1A签证的申请？-No.
5. 我家人现在以L2身份在同一公司工作，没有在中国总部的工作经历，能不能给她立即申请L1B？

-Depends on whether she is qualified for the L-1B. No law limits her to do that. Consult a lawyer.
