try visa approach. But you need to get a waiver for this visa later, and no one knows whether this waiver can cover your previous J2 visa if your hu*****and still can not get his J waiver first. Also thansferring to a J program in US is hard to get a waiver through China Embassy if your entry visa is other type of visa. Did your hu*****and try IGA? If his IGA aproach is hopeful or pending you dont need to hurry to shift to J1. If you want to make money you can do some "black work" temporilly.
