我的情况是这样的： EB3当年赶在07大潮时递了上去，485pending, 优先日期是06年底，本来也不想麻烦， 但是现在EB3遥遥无期，老板给我提了个职，也同意帮我再办一个EB2，现在有些问题想请教一下各位老师：

1） EB2的申请会对我的EB3有什么影响？

-No.

当两个case被link到一起，共用这个EB3有限日期的话，如果新的perm或者140被拒，会不会导致我现有pending的EB3 -485有问题，被审查甚至被拒？

2）我升职的话，会影响现有的EB3 perm么？工作地点和内容都没有什么大的变化

-It is possible to affect the Eb3 I-140 because PERM is position-specific. But if you and your employer convince USCIS tha you will work for the Eb3 position after the GC is approved, you may be fine.

3）我现在已有AP和EAD，如果再次申请了EB2，对于AP和EAD卡的使用什么影响？

-Not affect.

还可以自由用AP进出和用EAD工作么？

-Yes.

我的AP和EAD下半年都要过期了，如果现在申请eb2的话，到时可以再继续延期我的EB3的AP和EAD么？

-Yes.

4）公司的人事部一直说我工资和prevailing wage差别太大，和level3差1万左右，和level4差的更多， 我的H1B马上也要延期了，人事部说甚至H1B都会有prevailing wage的问题。这到底是不是大问题？

-Your salary must meet the prevail salary for the H1, and for Eb2 PERM also if your employer file Eb2 PERM for you. Your employer should pay you more salary to match your promotion, right?

5）我太太现在在国内，当时递交EB3的时候我们还没有结婚，现在这种情况下，重交EB2，她必须在哪一个阶段到美国才可以和我一起递交485?

-When your priority date for Eb2 or Eb3 becomes current if she is in US physically. She can not file I-485 when she is in China.
