If you have a W-2 job and you are due a refund, and if that refund was sent to your husband based on his fraudulent return, you should bring this issue in your next divorce proceeding to recover the refund together with your property division in the divorce case.
(2) Did your husband commit a crime? Yes, he filed a fraudulent tax return. If you want him get punished, you need to consult a lawyer.
