There is no preference for mother at law. Of course, the child's attachment to mother will be considered while the court determines the custody issue, but it is not the only or critical facor. In the same way, the child's decision won't be determinative either, but merely a factor the court will take into consideration. The standard for awarding custody is "in the child's best interest". What your friend need to do is convince the court that granting him the custody is in the child's best interest, financially and emotionally, in the short run and in the long run.
