租金没交全能eviction吗

房租本来5号要交，近日一个房客5号交了一半，说另外一半要12号才有钱交。我说可以。但是他12号只交了1/4, 所以还欠
1/4。我昨天去给了一个3天notice. 但是我有点疑问， 他这种没交全的情况是不是也是给3天notice？没有回应的话是不是同样去法庭file eviction?
