my point is, you can always argue and seems that

the police will have difficulty time generaing evidence.

If I were her, here would be my words to the judge: I checked the blind spot, safe, hence the lane switch.  I am not sure how the police is going to present against that.  The police might simply drive too fast and failed to pay attention to other's signals.
