Do a title search then you will know immediately the current status of it.
If you like the price, then sign the contract with the seller and add the following clause-
" The seller must provide a clean, insurable, and marketable title", though most standard sales contracts already include this clause.
If the seller doesn't have the title under his name, then you will not be able to close it, but lose almost nothing except the title search, home inspection, etc.
