You can recover only repair, not improvement.

So your tile and floor replacement cost cannot be recovered. 

Probably trash removal and painting cost could be recoevered, my guess is you are better off asking 3500 in small claim.  If you go to a court of record, you need a lawyer to help you.  It increases your cost. 

When you sue you (in small claim or formal court) have to sue both of them.  Otherwise the other party will blame the party you didn't sue and you will not be able to get a judgment.
