Why Subway has to apologize to you because you dont know how to properly store their products? If you can not make your action bullet proof, then your negligent is contribute to the incident.

From an attorney's prospective, since you can not guarantee that you kept the food in a good condition, that 2 hours will kill your case.

Before you think about going after some one, take a minutes to think if you can proof that beyond the reasonable doubt that opposite party is responsible for the damage.
