1 上次我小孩H4签证过期不到12个月，可是中间我（H1）换了工作

2 小孩在14岁以内，可是我们没有有效的H签证。有效的I797和I94不行。

是不是这种情况只能让监护人代签呢？再次感谢

At first, your or your spouse's parents (child's grandparents) can not be the 监护人 of the child in your case. 监护人 must be you and your spouse (the child's parents). So, both parents are requried with the minor child when applying for the H4 visa. One parent will also be OK but a written authorization or permission is required from the other parent.
