Not long ago, INS published a rule regarding 485 transfer. One condition is both 140s are approved (or approvable). The other condition is that PD is current. I remember the purpose of the rule is to prevent frivious filing and to defeat the tricks that somebody used just for maitaining EAD and AP.Despite the rule, I still believe that the officer still has a great discretion to conclude that yours does not belong to that categeory when applying the rule. If you decide to do it. I suggest you consulting with your lawyer. Your lawyer's trick (better sentense,personal connection ) may work better than yours.
