out of status & h1b

just wondering how INS knows that somebody is out of status if the school or the employee don't inform INS about it.
For instance, A is out of status since his I-20 was expired 5 months ago. Then A got an offer from company B which is willing to do H1B sponsor for him. Can his H1B petition be approved INS if the school hasn't informed INS about his out of status.
