I will send the tenant a notice for unpaid balance including late fee. And notify the tenant that all payments will be applied to teh unpaid balance first before applying to the rent. If not enough for rent, an eviction notice will be sent based on no-pay/partial payment of rent. That is your legal base for eviction.
