If you file lawsuit, the house can't be sold until the case is settled.

Once I almost cancelled my offer at the last minutes - one day before close of escrow. The agent told me he would get my money back.  Later, he fould a solution to my concern.  So the deal went through in that case.  A great agent! 

Your agent try to push you into the deal.
