question on Commission rebate

We just signed a contractor to buy a brand new house. We used a selling agent to get some money back from the builder. The agent agreed to give part of the commission fee to us. According to the agent, he will pay the tax and give us a check after tax.

My question: (1) Is it possible to get my part pre-tax? He insists to pay tax using our tax rate.

                         (2) If the agent pays tax as he said, do we have to pay tax after we get the check? Is it      counted in our income?
