回复：485排期到了，可485却file 不了，郁闷死了

当时帮我做的，不是我的雇主。我的优先日期是2008年6月。原想快到排期的时候就把H1从现在的雇主这儿转过去。现在一下子竟跳过这么多。可问题是，从2009到2010我不在的时候，公司发生亏损，律师说，实际我的140已经作废了。

-The only problem is that 公司发生亏损 which make your previous I-140 trouble. Because if you use this I-140 to file I-485, USCIS will ask your employer to show the ability to pay from the date of PERM filing to the date I-485 approval, and the 公司发生亏损 shows that the emplolyer can not meet this requirement. So, practically you may not use this I-140.

Otherwise, if there was no公司发生亏损,  you would just go back to work for the I-140 sponsor or the sponsor agrees to hire you back, then you can file your I-485. However, you can use the old I-140 2008的优先日期 for your new I-140. 

H1 转过去从现在领工资也不行了。不知律师说的对不对？

如果人不过去，就这样子file485上去，有没有批准的可能性？

-Hard to say, but most likely it will be denied. You had better ask your current employer or the old employer to file a new PERM/I-140 for you.

如果485被拒了，我2008的优先日期还能再用么？

-Yes.
