USCIS new memo issued on February 04, 2008 by Michael Aytes, Associate Director of Domestic Operations for the USCIS, in which it clearly indicates that under this new policy, if an application is otherwise approvable, and the FBI name check has been pending for more than 180 days, the adjudicating officer shall approve the I-485, I-601, I-687, or I-698 application and proceed with card issuance.
