islegal or not to work while EAD renewal application is pending

Just went to local office for my EAD today since my EAD renewal application has been pending more than 120 days now. Was told they had stopped issuing temporary EAD card from local office since Dec, 06 & either can they stamp on my notice for me to show the employer that I am authorized to work. She said it is up to the company when I asked her whether it is legal for me to work while EAD application pending. I asked her the same questions several times & her standard answer is up to the company.

So it is legal or not to work while EAD renewal application is pending?
