Contract Position: Property Specialist

Individual must be familiar with Contracts - Interpreting, Administering & Negotiating. Aggressive environment- tough skin, Self managing- take direction and run with it, problem solving/ think on their feet/resourceful. Any environment background is a plus, paralegal in a property transactional sense have proven to be a fit. Paralegal in a litigation sense is not a fit.
Job Overview:
The successful candidate will manage property issues associated with environmental claims, legal matters, and property access at various sites, including service stations, bulk plants, terminals, and/or orphan properties.
Coordinate the evaluation of claims and legal matters in conjunction with in-house and outside counsel and Project Managers.
Negotiate and assure that the Company’s position is secure in matters of environmental risk management, liability management, and contractual obligations.
Act as Health, Environment and Safety Representative on property transaction teams. Populate the STRATA database, and participate in team meetings.
In collaboration with legal counsel, negotiate environmental agreements and indemnity language with third parties.
Position Details Responsibilities for this position:
• Support Legal and Project Managers to determine the validity of legal claims and potential liability related to past / historical property or business matters.
• Work with Project Managers on various legal and access issues pertaining to their portfolio of projects.
• Serve as a resource for negotiating and securing various agreements in reference to property issues, such as executing site access and license agreements, environmental indemnifications, legal settlements, and the like as required. Research historical site status, conditions and contractual obligations in order to prepare appropriate agreements.
• Evaluate site specific factors such as current and predecessor’s history of ownership and operations.
• Participate in the development of site-specific strategies and business plans to evaluate alternatives, cash flow, environmental and business risk, and financial aspects of claims and legal matters.
• Field initial calls and correspondence from claimants. Manage the claims and legal matter evaluation process in conjunction with the Legal Group.
• Recommend site strategies to legal counsel and Project Managers to successfully resolve claims and/or property owner complaints/issues.
• Develop and negotiate Company’s position with claimants. Conduct appropriate research and file reviews to substantiate Company’s position with claimants.
• Respond to alleged environmental liabilities at formerly owned Company heritage sites.
• Coordinate efforts with other Company Operating Companies (i.e. Products, Real Estate, Tech Ventures, Legal, etc.).
• Assure Company’s position is secure in matters of environmental risk management, liability management, and contractual obligations.
• Coordinate independent companies to investigate and gather additional historical information, as appropriate.
• Determine and track access agreements and fees for environmental sites and negotiate the termination of such fees. Manage multiple supplier access liaisons for portfolio of sites.
• Participate as the Health, Environment, and Safety Property Transfer Representative for property transactions conducted by Company’s Operating Companies in the Western United States. Apply risk-based decision making process to determine scope; contract suppliers; and incorporate safety stewardship during field activities.
• This is a Safety Sensitive Position.
Required Qualifications
• Minimum of 3 years combination of experience in property transaction negotiations, project management, environmental management or contractor safety management.
• Excellent verbal and written communication skills.
• Demonstrated experience managing multiple tasks simultaneously while meeting deadlines and an ability to adapt quickly to ever changing priorities.
• Experience negotiating real or potential disputes effectively with third parties.
• Ability to function effectively in a hostile or adversarial environment.
• Ability to navigate through databases and web-based applications such as SharePoint.
• Excellent people skills. Ability to work well in a team environment.
• Self – starter; highly motivated.
• Willing to travel 5%.
Preferred Qualifications
• Experience in the following areas:
o Supporting Retail and Terminal operations in a claims related position
o Working with planning and permitting agencies
o Managing field crews performing environmental related activities
• Knowledge and understanding of the following:
o Real estate and environmental law
o General construction and redevelopment issues
