It is understood that all keys will be returned upon vacating the apartment.  There will be a charge of $75.00 per lock for lost keys or keys not returned for apartment entrances and mail boxes.  Duplication of keys is prohibited.  Additional keys are available through the office.  Re-keying or placement of additional locks on apartments is not allowed.

1.  I/We agree to lease the above apartment from the LESSOR starting on  and ending on .  Lease Property is to accommodate a total of  adult(s) and/or child(ren), unless written approval is given by the Lessor for a variance, and is only to be used as a private residential dwelling.  No business may be operated from within the apartment.  Guests are permitted for short periods of stay.  Should guests stay more than thirty (30) days, or if more persons are found to occupy the apartment than stipulated, the additional rent shall be ten dollars ($10.00) per day and/or night per individual.  If you plan to move at the end of your initial term you are required to give the LESSOR written notice 30 days in advance of the expiration date.  Any hold over after the above expiration date, with the written consent of the Lessor, shall be construed as a Month-to-Month tenancy in accordance with all terms of this agreement, or any addendum, modification and rent increases.  All month to month tenancy’s shall run from the first of each month to the last day of the month.  Once you have become a month to month tenant you are required to give a 30 day written notice to vacate on or before the first day of your last month.

I/We agree to pay the Lessor as rent for said apartment $7200.00 per lease, in installments of $600.00 per month, due on the first day of the month, if paid by 5:00 P.m. on the first day pay $600.00, after 5:00 pm $650.00.  Rent must be paid by mailing to:

THERE WILL BE A $50.00 FEE FOR ALL UNPAID CHECKS RETURNED FROM THE BANK FOR ANY REASON.

The Security Deposit is not to be deducted by the Lessee from rental charge at any time.
If the apartment appliances therein are not thoroughly cleaned and/or if all rent, fines, or any other past due charges are not paid in full upon vacating said apartment, these charges will be deducted from the security deposit.  If the deposit does not cover these charges, a bill will be sent to collection.  The Lessee will pay interest on any unpaid account at 1% per month, beginning at the date due, as well as, all costs for collection to include but not limited to court costs, reasonable attorney fees and any other LESSOR Administration Fees, cleaning costs and Rules and Regulations fines:

4)  $51.00 – Landlord Tenant Writ Fee 10)  $100.00 – Fine for Smoke Detector Found Disconnected   
5)  100% - Any Court/Sheriff Fees 11)  $100.00 – Fine or increase in water/sewer bill for failure to notify LESSOR of any plumbing leaks or running toilets.   
6)  $50.00 – Per Hour – LESSOR Court Appearance 12)$50.00 – Rent Paid After 5PM on the 1st   
  


After the above ending date this lease shall automatically become a Rental Agreement.  Per state law, thirty (30) days written notice shall be required to terminate by either party; if thirty (30) days notice is not given, the entire security deposit will be forfeited.  After such notice, the Lessor or his agent may enter the apartment to show it at reasonable hours.

2.   LESSEE AGREES TO PAY THE FOLLOWING UTILITIES:

Furthermore, it is the responsibility of the Lessee to contact each utility and place into their name on or before the start lease date.

3.  PETS:  No dogs or other animals, birds or pets shall visit or be kept in or upon premises without the Lessor’s written consent (Addendum D); and consent so given may be revoked at any time.  Lessee understands that if he/she obtains a pet without written consent, he/she will be evicted.

4.  The Lessee agrees to refrain from causing excessive noise or creating conditions that might reasonably disturb the other residents, or impair the attractiveness of the apartments or grounds.  Children shall not play in common area in any building.  HALLS, PORCHES, AND GROUNDS SHALL NOT BE USED AS STORAGE FOR ANY OF THE LESSEE’S PROPERTY.

5.  Autos shall be towed away at the expense of the Lessee if parked on lawns or along the driveways blocking dumpsters.  Please inform your guests.  Inoperable, non-inspected, or unregistered autos are not permitted on the premises.  Should any such vehicle be found, the Lessor may immediately have the vehicle towed away at the owner’s expense.  To keep the property and the surrounding community attractive, mechanical repairs are prohibited.  Only those motor vehicles registered with the Lessee on the Rental Application will be allowed to park on the premises.  Notification of change of vehicle is required.

6.  The Lessee clearly understands and willingly agrees that there will be not gatherings which results in any disturbances to other residents and that stereo volume, TV volume, musical instruments and voices should be KEPT LOW AT ALL TIMES,  such that they cannot be heard in neighboring apartments.  If you are being disturbed by others, we request that you please call us at once, as the noise is apt to be disturbing other residents as well.  Lessee will be held responsible for the conduct of their guests.

7.  WINTER SNOW PLOWING:  Lessor is responsible for snow removal from parking/driveway area.  Lessee is responsible for snow remove from the walkways.  If the Lessor does snow removal, PLEASE go out and move your car when you hear the plow in the parking lot.  The plow can clear your space and the driveway area surrounding it.

8.  WATERBEDS ARE NOT ALLOWED.   BARBECUES/GRILLS NOT PERMITTED.

9.  I/We agree that all injury to said building caused by moving any property of the Lessee(s) in or out of said building and all breakage or other injury, done by Lessee(s) or other members of his family, agents, servants or visitors of the Lessee(s), as well as, damage caused by overflow or escape of water, steam, electricity or other substance, due to the negligence of the Lessee(s) shall be repaired by the Lessee(s).  However, the Lessor may have the necessary repairs made and collect the expense thereof from the Lessee(s).

10.  INSURANCE AND LIABILITY:  I/We agree that the Lessor may take out such insurance in his name and at his own expense, to cover and protect his own interest in said building, and in the event of the whole or partial destruction of said building by fire or otherwise, said Lessee(s) are not entitled to share or participate in any insurance paid to Lessor.

The Lessor shall not be liable for any damages to any property or person at any time on said premises from steam gases, electricity, water, rain or snow, whether they may leak into or issue, or flow from any part of said building, or from the pipes or plumbing works thereof, or from any other place.
The Lessee(s) agrees to hold the Lessor harmless of liability to any person(s) by reason of personal injury or from any claim for property damage resulting from, pertaining to, or in any way connected with the occupancy or use of said premises by said Lessee(s).
No responsibility is assured for the loss of an individual’s personal property, whether due to theft, fire or any other cause or for an individual’s personal liability as residents of the premises.  IT IS RECOMMENDED THAT THE LESSEE(S) CONSULT THEIR OWN INSURANCE BROKER FOR PROPER COVERAGE.

11.  The Lessor has the right to enter upon said premises with 24-hour notice and at reasonable times for the purpose of inspecting, repairing and/or maintaining said premises.  The Lessee(s) agree to make immediate payment for damages discovered during routine inspections in the amount determined by estimates from a contractor selected or approved by the Lessor.  In addition, where it may be appropriate the Lessor may enter said premises on a monthly basis to read water meters.

12.  REPAIRS AND MAINTENANCE:   Please make all requests for repairs and maintenance in writing and/or by a phone call or facsimile to the Property Manager at the Dover office.  Unless further notified, this will be:

Repairs and maintenance requests must be submitted between the hours of 9:00am and 5:00pm, Monday through Friday.  Requests after these hours and on Saturday, Sunday or legal holidays will not be honored unless health or property is endangered.  Lessee(s) shall not make any repairs or alterations to the premises or to the equipment therein or do any painting, or make installations of the following unless written permission is granted:

 
1)  Additional locks or fixtures; 2)  Additional electrical wiring;   
3)  Deep freezers, dishwashers, washers or dryers; 4)  Outdoor construction of any kind, including fences   
5)  Scotch tape, stick-on picture hinges, decals or transfer picture, or other adhesive materials, or any nails, bolts or screws.  Picture Hanger Hooks are authorized.  If you have any questions or need to see a sample, check with the Lessor. 

DRAINS:  Lessee(s) shall be responsible for periodic drain maintenance.  Furthermore, Lessee shall be responsible for any plugged drains or toilets within their rental unit, and shall pay for any damage to the building caused by overflow.
PLUMBING/TOILET LEAKS:  Lessee shall report to the Lessor all leaking faucets and toilets which fail to shut-off properly.  Failure to report leaks may subject Lessee to fine in accordance with paragraph 1D 13.
ELECTRIC LIGHT BULBS:  Lessee is required to pay for their light bulb replacements, including that of fluorescent bulbs.

13.  We will work hard to maintain the apartments in a first-class condition.  If you do your part by making sure that you place all of your rubbish in the dumpster container, and pick up that occasional scrap of paper you may see, the result will be pleasant living conditions of which we can all be proud.

14.  LOCK-OUTS:  If you lose your keys or lock yourself out, you must contact the LESSOR to arrange for someone to unlock your apartment.  A $50.00 charge may be assessed. 

15.  SUBLETTING:  SUBLETTING IS NOT PERMITTED.

16.  CANCELLATION/TERMINATION:

THIS LEASE MAY BE CANCELED ONLY IF THE LESSEE RECEIVES A FULL-TIME JOB TRANSFER AT LEAST FIFTY (50) MILES DISTANCE FROM THE APARTMENT.  THE LESSEE SO TERMINATING AGREES TO PAY RENT IN FULL THE FIRST OF EACH MONTH UNTIL THE APARTMENT IS RE-RENTED, UP TO A MAXIMUM OF THREE (3) MONTHS.  ADDITIONALLY, THE LESSEE AGREES TO PAY ONE HALF MONTHS RENT AS A RE-RENTAL FEE.
IF THIS LEASE IS CANCELED FOR REASONS OTHER THAN A JOB TRANSFER, THE LESSEE AGREES TO PAY A RE-RENTAL FEE OF ONE-HALF MONTH’S RENT, PLUS RENT AND UTILITIES FOR ANY VACANT PERIOD DURING THE REMAINING TERM OF THE LEASE.


AFTER THE LESSEE TERMINATES HIS/HER LEASE AND REMOVES HIS/HER BELONGINGS FROM THE PREMISES, THE LESSEE(S) AND LESSOR SHALL INSPECT THE APARTMENT, NOTING ANY DAMAGES CAUSED BY THE LESSEE(S).  THE SECURITY DEPOSIT SHALL BE REFUNDED WITHIN THIRTY (30) DAYS, LESS ANY UNPAID LIABILITIES AND REPAIR DAMAGES.
MILITARY CLAUSE:  IN THE EVENT THE LESSEE IS A MEMBER OF THE UNITED STATES ARMED FORCES ON EXTENDED ACTIVE DUTY AND RECEIVES PERMANENT CHANGES OF STATION ORDERS, OR IS RELIEVED OF ACTIVE DUTY (WITH HONORABLE DISCHARGE), THE LESSEE MAY TERMINATE THE LEASE UPON GIVING AT LEAST THIRTY (30) DAYS NOTICE TO THE LESSOR, ATTACHING A COPY OF THE OFFICIAL ORDERS WHICH WARRANT TERMINATION.
IN ALL CASES, A 30 DAY WRITTEN NOTICE IS REQUIRED.

17.  EVICTION:  Failure to adhere to these regulations will result in eviction.  The Lessee(s) is liable for the unpaid portion of the term of the Rental Agreement until the apartment is re-rented (i.e. rent, heat, etc).  The Lessee(s) will pay all legal and court costs and damages to the property.

18.  LEGAL AND COURT COSTS:  The Lessee agrees to pay all court costs and reasonable attorney fees which may be paid or incurred by the landlord in enforcing the covenants, conditions, obligations and agreements of this rental agreement in the event of default by Lessee.  Refer to paragraph 1D for partial list of costs.  Parties agree all Landlord/Tenant actions including Small Claim Actions, will be in the District Court at (court address).

19.  MOVE-IN/OUT CHECKLIST:  The Lessee has viewed the apartment prior to execution of this Rental Agreement, is familiar with the same and accepts the said apartment in its present condition, subject to the terms, conditions, and provisions of this Rental Agreement and any modifications or additional provisions as specified below.  Furthermore, the Lessee agrees to conduct a detailed inspection of the unit prior to physically moving in, and will submit Addendum B – Move-In/Out Checklist within five (5) days of lease signing.  Failing this, Lessee will accept Lessor’s records and/or recollection of the unit’s condition at the start of this lease.  Addendum B is used to determine damage assessment against the Security Deposit.

20.  LEAD WARNINGS STATEMENT:  Housing built before 1978 may contain lead-based paint.  Lead from paint, paint chips, and dust can pose health problems if not managed properly.  Lead exposure is especially harmful to young children and pregnant women.  Before renting pre-1978 housing, Lessor must disclose the presence of known lead based paint and/or lead based paint hazards in the dwelling.  Lessee must also receive a federally approved pamphlet on lead poisoning prevention.

21.  ADDITIONAL PROVISIONS:

 

 


22.  SIGNATURE:   If the Lessee is not eighteen (18) years of age, his/her parent or guardian must sign the Rental Agreement.  The parent and/or guardian must give their complete home address.

23.  Please note carefully before signing:  If there is more than one (1) occupant per apartment, one or all occupants will be held liable and/or responsible for all damages and breach of the Rental Agreement.

24.  WINDOWS:   All tenants who have heat included in the base rent shall be subject to a $50 fine for leaving any windows open during the heating season.  The heating season shall run from November 1 to the last day of April.

25.  Any changes to this lease must be in writing, dated, and signed by the Lessee(s) and Lessor.  The following, if any, attached Addendum(s) have been made part of this agreement:
