有人碰到过这种情况吗?

我在加拿大,上个月底所有的subjects都remove了,但是交房要到6月以后,在terms and conditions里面有要求立即维修的项目,并说好这些项目在4月15日前完成,但是,15号我们去的时候,seller还是什么都没有做。

现在seller算不算已经breach of contract? 我能拿回订金退出合同码? 谢谢指点

3. TERMS AND CONDITIONS:
16. IMMEDIATE REPAIRS. The Seller agrees to undertake, at the Seller's expense, the following remedial work
on an immediate basis:
- Cleaning of rain gutters to ensure smooth rainwater flow throughout the rain gutter system.
- Patching of the exterior walls with stucco, whererever there is currently missing stucco
- Repair with a poly plastic seal the bathtub and bathtub enclosure in the lower left hand suite, to the extent that it
shall be completely sealed off from water being able to run behind and underneath the bathtub enclosure
The Buyer shall be permitted to conduct a Walk Through on or before April 15, 2018 to ensure that the immediate
remedial work as outlined above has been completed. The Seller shall grant access to the property with at least 24
hours notice for this purpose.
