The speeding violation in the law does NOT play average speed.  As long as you drive 36MPH in a 35MPH zone for just one second, the cop can give you ticket.  There is also no tolerance on the number at all.  Don't believe anyone tell you that "drive 5 miles faster than the speed limit the cop won't give you ticket".  it's BS.  You told the cop that you drove 46 then slow down to 40.  That is pretty much admitted the violation since it's 35MPH zone.  There isn't any chance that you can shake off the ticket in court room since the cop is going to repeat what you said to the judge.   You will be 100% found guilty in the court room.  If you didn't self admit at the scene, you may be able to ask the cop to show the laser gun usage report to prove the evidence.  Most of the cop does not bring that to the court room and the judge may dismiss the case for the reason of insufficient evidence.  Since you already self admitted, the judge pretty much ends the hearing right there.  Don't attempt to deny the cop's statement or lie in the court room.  It's useless and may bring you more trouble.

Your have two options to deal with the ticket.
 
1. Pay the penalty since it's so low. Go to the traffic school to mask out the violation point in DMV.
2. Fight the ticket outside the court room if you really have a lot of time to spare.  The way may involve a lot of technique, betting your luck and beating the vulnerability of the law.
