EB2 PERM I140 approved。priority date是2016年6月。现在485排期已经到了。但是处于职业发展考虑已经接受了一个加拿大的offer. 我已经向我现在的工作单位提出辞职了。我不能申请485了吧？我现在的工作单位可以取消我的140吗？

-No, but you cannot use it to file I-485 unless you come back to work for the employer. Also, if you cannot file I-485 within one year from the date your I-140 priority date is current, the I-140 will be invalid even if you come back to work for the same employer.

 

如果离开美国两三年，再回来，如果有单位给申请绿卡，还可以用这个PD么？-Yes.如果可以的话，我就没有排期了吧？现在需要做什么以便将来还可以用这个PD？-Keep the copy of your I-140 appoval notice.  如果两三年后得到的职位和现在是同样的，只是高级和初级的区别。那时还需要办理Perm吗?-Your new employer must file a new PERM and I-140, but you can use the old priority date.

 

另外一个计划：如果现在自己申请NIW为以后回来作准备。如果NIW批准的话，还可以用这个PD么? -Yes.一定需要一个美国的雇主才能申请485吗？-You had better have a job.
