也谈美国三任总统的禁刺令

1976年2月18日福特总统签署11905号总统行政令，第一次明确禁止出于政治目的暗杀(political assassination)。

"No employee of the United States Government shall engage in, or conspire to engage in, political assassination."

有“political assassination”就有non-political assassination，如何定义？  所以这是个会搞不清楚的“loop-hole”。

1978年1月24日卡特总统签署12036号总统行政令，进一步扩展和明确了这条禁刺令, 无条件地禁止直接或间接介入任何种类的暗杀活动。

1981年12月4日里根总统签署12333号总统行政令，重申了上述禁令。

“No person employed by or acting on behalf of the United States Government shall engage in, or conspire to engage in, assassination.”

 

进入90年代随着世界局势的不稳定和恐怖活动增加，1998年这条禁刺令被重新解释得到一定程度的“松邦”。但留下了诸多问题，有许多不确定性。

“As early as 1998, this proscription against assassination was reinterpreted, and relaxed, for targets who are classified by the United States as connected to terrorism”

2000年9月11日 9.11恐怖袭击，震惊世人。2001年国会授权总统可使用一切必要的和合适/合理/恰当的手段打击任何与9.11恐怖行动有关的个人，组织和国家。

A 2001 law allows the president “to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons” – without waiting for congressional approval.

自从9.11后世界进入了恐怖活动超限战和文明社会自卫反恐时代, 许多传统的定义变得模糊了。时代变了，简单抱守三位前总统的禁暗杀令无异于刻舟求剑。如何既遵守捍卫自由民主社会的核心文明价值同时又要有效地防止打击任何形式的恐怖活动是项仍在进行着的艰巨的任务。
