买主贷款 pre-approval with conventional loan with 3% down with PNC bank,
seller agent found out = 22 days later and about 10 days before closing, it has not gone through underwriting.
In fact within 3 days under contract, buyer signed FHA loan doc. Buyer can't ge loan and settle on time so give void notice using conventional financial contingency.
buyer agent said buyer can't qualify for either conventioanl or FHA> 不过没有出信，只是一个PNC bank email saying they do not qualify. Yet there is only 1 loan number, they said buyer was denied from both conventional and FHA. 卖主认为买主故意欺诈。卖主浪费了45天。
Then buyer switchs bank on settlement date, and ask for 14 day extention for a new loan. But they do not want to risk a penny of EMD, just want free extension.
Seller demands some part of EMD as guarantee if buyers can't get loan again. Buyer rejected. Seller also demands seller credit, since seller will not sell to them if knowning it is FHA loan, nor sell at the price (about 2% off sales price).
THen buyer sends out void contract notice and release EMD.
Seller wants to void contract, bring it back to market, but not release EMD until it is clear there is no 欺骗。 Almost 99% there is 欺诈 with first loan officer. Seller wants to know if he can sell first, then sue buyer for damage after settlement with new buyer.
Is it possible?
If not, can seller rent it?
