请教单身老猫

I filed I-140 and I-485 two times. First (EB1) in Maech, 2005.turn in the REF for I-140 at the end of August. I submitted second time (EB2)before OCT.1. First I-140 got approved at SEP.22, 2005.And Daughter's I-485 appoved in SEP.28, 2005, now ahe already got her green card.There is a lUD at the SEP.28 for me too. but the information never changed as the first time, even LUD after FP.And I received the denied notice for second I-140. The reason is as following:

A review of Service records indicates that the beneficiary's status was adjusted to that of a lawful permanent resident on September 28, 2005 (classification code:"E16"; priority dat: March 26, 2005; I-485: ref:SRC05 258 51444] (I added here, src 05 258 51444 is for the second I-140)

In the context of Section 203 (b) of the INA, a visa has already been allocated to the beneficiary in conjunction with his adjustment of status. As the beneficiary is already lawfully resident in the United States, the instant I-140 must be denied as it encompasses a benefit and an immigrant visa that already been accorded this beneficiary.
