dispute with builder

Dear DX:

I am just having a problem with my builder. I bought a house last October. The sod was bad, so the builder wrote me a letter, saying they will treat it. If not good, they would replace all the bad places. After a month, it was still bad. Then they wrote me a another letter, saying they would come back this spring and treat the sod. If no response, they would replace all. It's been another month now. They say need another 30 days and I didn't water it enough. I've filed complait with BBB. I am not sure if that will be helpful? Or are there anything else I can do? I think in the contractor, there is a place saying no lawsuit on arbitration. Any suggestions? Thanks in advance.
