Chinese court jurisdiction follows residency. If both parties are foreigners but one party lives in China, like your hu*****and, Chinese court can take over jurisdiction. However, a Chinese court will proceed on the divorce case on only two conditions. One is that you consent to the jurisdiction. Second is that if you were married in China and the court in your current resident country does not take your case because you were married in China. The second case obviously does not apply here since the NY supreme court has taken on your case. In term of the first one, that is when you have to back to china or hire someone there to argue. Do not answer any paper from him or from the Chinese court without consulting a local attorney there who is familiar with international divorce.
