纽约的一个律师说的情况和AKC回复的一样,就是学校开学在6月20日,我的身份转换最早提前30天,就是5月21日,当我的L2身份只能到5月9日,就有一个GAP出现了,USCIS可以否决我的转换要求,但是那个律师说L2的60天宽限期是存在的,因为有客户这样办理过,我从不同律师地方,得到不同的解释,所以想知道为什么L2是没有宽限期的,2017年1月17日的法案不是明确了可以有60天宽限期吗?
-You are right. You have the grace period of 60 days based on the new rule. I just forgot the new rule which was effective in January 17, 2017. By the way, if you file your I-539 before your L-2 I-94 expires, you are legal to stay, and wait for the change of status approval. If the F-1 is approved after May 20 or later, then you are not considered to have unlawfyl presence and can continue to study. So, you are very safe!

-I-526 is related to your spouse only, not you! You only get the benefit to file your I-485 based on your spouse's I-485 in the future. Before you file I-485, nothing will be related to you.
