PERM在request for reconsideration之后仍旧被拒，律师建议在request for review with BALCA的同时，让同一家公司给我新办一个different position的perm。

请问这样可行吗？

-Your employer can not have two pending PERM applications at the same period of time, so if the employer request for review with BALCA (equal the PERM is pending), then the second new PERM may not be allowed. So, talk to your lawyer about this.

如何界定different？

-The responsibilites should be significantly different between the two PERM position. Talk to your lawyer.
