父母2019年回国后，因为疫情就没能回来，去年四月份母亲去世，父亲想过来和我们一起住。

询问了一下律师，说申请SB-1的几率不好，不如直接入境，看看怎么样。

两种情况都要说不能回美国的理由，下面可能成立吗？

1. 中国的疫情控制直到今年才结束，期间回美国非常困难；

2. 母亲去世后，按照风俗父亲必须在家乡守一年。

-These reasons probably are not enough to justify for SB-1 visa application or for entry to US directly. It seems impossible for your father to get the SB-1 visa. Also, it is difficult to predict what will happen at the port of entry if your father just returns to US using the green card because of his overstay in China for too long time. If the immigration officer at the port of entry is nice, he may be Ok to enter US, but if the officer is tough, he may have trouble to enter US or he may be required to go to the immigration court after he enters US. 

So, in my opinion, because your father is not young and is not very healthy either, he had better abandon the green card and then, apply for B2 visa to enter US. If he wants to get the geen card again, you may sponsor him 90 days later after he enters US using B2 visa as you did before. 

 

如果直接飞加拿大，从陆地回来（这样我可以陪同），进关的可能性如何？即使进关，是不是得打官司？

另外父亲是不是放弃绿卡，申请签证，到了这边重新申请绿卡？

父亲身体不太好，不能折腾，请问这种情况下最好的方案是什么？
