是加州大学2021年12月的本科生毕业生， 在申请OPT。

收到学校国际生办公室办OPT的I-20在学校通过。 误以为是学校国际生办公室30天以内继续把申请递交给USCIS。

刚发现是学生本人30天内递交给USCIS这个OPT申请以及申请OPT用的I-20.

已经错过30天的application window。F-1已经失效， 这样也非法居留了1个月18天。

怎么办？

1. 必须马上离境吗？

-Because your school (Univ of California) has extended your I-20 for OPT (i.e., requested OPT in SEVIS for you), you may ask the International Student Office to see whether your SEVIS ID is still valid. If yes, you may apply for a new program or Master/Doctoral Program, then do the F-1 transfer within US. If your SEVIS ID is not valid, then you can apply for a new program or Master/Doctoral Program and get a new I-20. Then, go to Canada or China to get the F-1 visa to come back.

2. 可以留在美国境内为这个OPT情况上诉吗？-No. 特别是最近疫情期间马上回国基本不可能。

3. 需生有加拿大的旅游签证，好像可以在加拿大待180天。

-Then, you need to come to Canada as soon as possible.

4. 以后申请上了美国的硕士或者博士研究生，办美国签证回因为这个非法居留收到阻碍？

-Normally no if you leave US very soon e.g., within one to two months. But if you stay in US illegally for more than 6 months or one year, you will be subjected to 6-month or 10-year bar
