8老师, 我外甥今年6月份在美国高中毕业, 国际学生身份, I 20 到6月30日到期。他现在被当地一家大学录取, 按国际学生申请, 学校答应给新的I20, 但是学校要在今年9月底才开学。我外甥现在等移民签证, 递交了D260, 你的建议是移民签证面试前不要离开美国, 要不就回不来。我的问题是, 如果他不回中国, 他现在的学生签证只能让他合法留在美国到6月30号, 新的I20要到9月底才拿到。在美国的3个月暑假算不算黑在美国?

-He has the F-1 grace period of 60 days after he completes his high school study. The new school (the college) can issue him the I-20 in June or July, but he cannot attend the college until the fall semester starts. After he gets the I-20, he can legally stay in US even if he will report to the college in Sept. So, just talk to the International Student Office at the college, and they know this rule well and know how to deal with it.
