问题一：我是J1 身份，拟回国服务两年。但未成年女儿 J2 目前在美国读书，准备转成F1. 我回国两年后再回美国 申请绿卡，女儿没有回国，她 的 J2 要不要 waiver?
- Based on the law,  J-2 holder must independently satisfy the home residency requirement apart from the J-1 holder. If you get J-1 waiver, then your child will automatically get J-2 waiver. But if you just go to China and stay in China for tow years, then your child also has to go to China to stay there for two years. Thus, both of you can meet the two year home residence requirement. Your child cannot get J-2 waiver independently until she is over 21 years old in the future.


问题二：如果我与美国公民结婚，我回国服务两年后再申请绿卡。而女儿（12岁）如果不要 waiver, 她现在可不可以由她继父单独 sponsor 她的绿卡或其他身份。这样女儿可以在美国继续上学。

问题三：我 J1 期间回国休假探亲，是不是算在二年居住之内？
-No because you have not completed your J-1 program yet and you still come back to US as J-1 holder after short visit in China.

以后回国居住期间用 B2 签证来美国探亲，是不是也算在二年之内？
-No. The time you spend in US cannot be counted. For example, you return to China on December 30, 2018, then your two-year home residence should be ended on December 30, 2020. But if you visit US for one month during this period of time, then your two-year home residence should be ended on January 30, 2021.
