请教一下，我现在是H4签证，有EAD和AP，先生的140也已经批准了，我们在等I485，现在等的时间很长。
如果我现在回国探亲，我应该带哪个I797回去？
因为我以前申请过给H4的EAD，但我并没有去工作，我也忘了，回国时就带的申请EAD时拿到的I797，回来时，我仍旧申请H4, 签证官说发现我有两个有效的I797，然后给了我H4, 还特地跟我说H4不能工作，我还觉得挺奇怪为什么跟我这么说，现在我意识到，是不是他给我H4 I797就是不能工作的，如果我要工作，就要再去申请EAD, 拿相应的I797, 就好像我重新拿H4, 就让以前的那个I 797失效了，所以我不知道我应该怎么做，我不希望EAD失效，但也不希望H4身份失效。
-If you want to apply for the H-4 visa in the US Consulate in China and use the H-4 visa to come back, then you need to bring the copy of your spouse's H-1 approval notice. The H-4 approval notice is useless if you leave US. Of course, you also can use AP to come back and thus, you don't need to waste your time and money to apply for the H-4 visa. You can use the I-485 based EAD to work if you want to.
As long as your spouse keep the H-1 status valid, you can get the H-4 status back if your I-485 is denied. So, I would suggest you to use AP to travel.
